Privacy Policy

GeniusCloud is operated by Genius Systems NV, Ballewijerweg 12, 3520 Zonhoven, België (BE0716.797.039). We are the data controller for the personal data described here. For any question about this policy or your data, contact contact@bargenius.be.

What we collect
  • Account data — your email address, the company or venue name you sign up with, and the date your account was created. Passwords are handled by Google Firebase Authentication and are never visible to us.
  • Licence data — your licence identifier, plan tier, agreed price, expiry date and the dispenser serial numbers linked to your account.
  • Operational data from your dispensers — pours and orders (drink, volume, timestamp, cost and margin), liquid levels, hardware events and activity logs.
  • Content you upload — recipes, cocktail cards, liquid libraries, venue logos, and any receipts you scan for the event calculator.

We do not collect special categories of personal data, and the platform is not intended for use by children.

Why we process it, and on what basis
  • To provide the service (performance of our contract with you) — running your account, displaying your statistics, and operating your dispensers.
  • To support and bill you (contract, and our legitimate interest in running the business) — activating licences, answering support requests, and sending the reports your plan includes.
  • To keep the service secure and working (legitimate interest) — diagnosing faults and preventing abuse.
  • To meet legal obligations — retaining what accounting and tax law requires.
Who we share it with

We do not sell personal data. We share it only with the processors that run the platform:

  • Google Firebase / Google Cloud — authentication, database, hosting and server functions.
  • Our email provider — transactional email such as verification, password resets and reports.
  • OpenAI and Anthropic — only when you use receipt scanning, the receipt image you upload is sent to one of these providers to extract its line items. Do not scan receipts containing personal data you do not want processed this way.

Some of these providers may process data outside the European Economic Area; where they do, transfers rely on the European Commission's standard contractual clauses.

How long we keep it

Account and licence data are kept for as long as your account is active. Operational data (orders, pours, activity) is retained so that your historical statistics remain meaningful. When you close your account we delete or anonymise your data within 30 days — except records we are legally required to keep longer, which we retain for the statutory period: seven years for accounting records and their supporting documents under Belgian law, and longer where a specific tax rule demands it.

Your rights

Under the GDPR you may request access to your data, correction of it, erasure, restriction of processing, portability, and you may object to processing based on legitimate interest. Write to contact@bargenius.be and we will respond within one month. You also have the right to lodge a complaint with your data protection authority — in Belgium, the Gegevensbeschermingsautoriteit / Autorité de protection des données.

Security

Access to your data requires authentication, and each account can only reach its own catalogue, orders and dispensers. Administrative access is limited to staff who need it to operate and support the platform.

Cookies

We use only what the service needs to function: a session cookie that keeps you signed in, and a preferences cookie that remembers your theme and layout choices. We do not use advertising or third-party tracking cookies.


Terms of Service

These terms govern your use of GeniusCloud, provided by Genius Systems NV. By creating an account you agree to them.

Accounts and activation

Creating an account does not by itself grant access to the platform. New accounts are pending until we activate them against a licence. You are responsible for keeping your credentials confidential and for activity that happens under your account, and you agree to give accurate registration details.

Licences and fees

Access is licensed per dispenser per year at the tier agreed with you. Fees, tier and expiry date are those recorded on your account. Unless agreed otherwise in writing, fees are payable in advance and are not refundable for a period already started.

Acceptable use
  • Do not attempt to access another customer’s data, or to circumvent authentication or licence limits.
  • Do not interfere with the operation of the platform or the dispensers of others.
  • Do not upload content you have no right to use, or anything unlawful.
  • Do not resell or sublicense access without our written agreement.
Availability

We aim to keep GeniusCloud available continuously, but we do not guarantee uninterrupted service: maintenance, faults and third-party outages happen. Dispensers continue to pour independently of this portal. No specific uptime is promised unless we have agreed one with you in writing.

Your content

Your recipes, cards, libraries and operational data remain yours. You grant us only the permission needed to host and display them to you and to operate the service. You can export or request a copy at any time.

Liability

To the extent permitted by law, we are not liable for indirect or consequential loss, including lost profits or lost sales, and our total liability in any twelve-month period is limited to the licence fees you paid in that period. Nothing here limits liability that cannot lawfully be limited, including for death, personal injury, or fraud.

Suspension and termination

You may stop using the service at any time and ask us to close your account. We may suspend or terminate access if a licence expires or is unpaid, or if these terms are seriously or repeatedly breached. On termination your right to use the platform ends; see the retention section above for what happens to your data.

Changes

We may update these documents as the platform changes. Material changes will be notified by email or in the portal before they take effect. The date at the top shows the current version.

Governing law

These terms are governed by Belgian law. The courts of the judicial district of Limburg, Hasselt division, have exclusive jurisdiction — Zonhoven falls within that division — without prejudice to any mandatory rights you have where you live.
